Bombay High Court suo moto PIL 71 of 2013
This Suo moto public interest litigation (PIL) concerns poor condition of roads in the areas falling within the jurisdiction of the Municipal Corporations and Municipal Councils in the State. This petition takes a note of hardships and inconvenience caused to the citizen due to poor state of roads in the state and in particular, in the municipal areas.
SC Judgement
The issue which has arisen for consideration in the present Criminal Appeal is whether the Guwahati High Court was justified in issuing directions that road traffic offences shall be dealt only under the provisions of the Motor Vehicle Act 1988 and in holding that in cases of road traffic or motor vehicle offences, prosecution under the provisions of Indian Penal Code, 1860 is without sanction of law.
